1. 1. You are about to view the Terms of Use and Privacy Policy of the Cockpit Country Website, hereinafter referred to as “site.” This site is a service made available by the Cockpit Country Local Forest Management Committees (CCLFMCs). All rights to this site are hereby reserved.  
2. 2. Please read this page carefully. By accessing, browsing or using this site, its content, services or information, you acknowledge that you have read, understood and agree to be bound by the Terms of Use and Privacy Policy of the CCLFMCs.
3. 3. All online services made available via this site may only be used under the terms of the Terms of Use and Privacy Policy outlined herein and any applicable licenses.
4. 4. If you do not agree with the Terms of Use and Privacy Policy, you must not use and must destroy all materials obtained from this site and all copies thereof.
5. 5. If you access this site on behalf of your employer or any other entity, you represent and warrant that you are authorized to accept these terms on your employer’s or other entity’s behalf.
6. 6. Please revisit this page periodically to review current information as the CCLFMCs reserves the right to change its Terms of Use and Privacy Policy without notice and by continuing to access or use this site, you agree to be bound by any revisions to same.

1. 1. The material on this site is protected by applicable trademark and copyright laws. The images on this site are the property of CCLFMCs and its partners. As a result, this site may contain other proprietary notices, licenses and copyright information, the terms of which must be observed and followed by you. Where there is any conflict between our Terms of Use and Privacy Policy and any applicable license, then the applicable license will prevail.
2. 2. Except as otherwise expressly stated, your use of this site does not grant any licenses to any copyrights, patents or any other intellectual property rights.

Further, you may not remove or alter any trademarks of the CCLFMCs or its partners, or co-brand your own products, material, or service marks with any such trademarks, without our prior written consent. You may not copy or reproduce, whether in whole or in part, any text, graphics, logos, trademarks, photographs, audio or video material unless expressly permitted by CCLFMCs and its partners. You must request permission to reproduce or distribute material found on this website by contacting the CCLFMCs. In the event that you obtain permission from the CCLFMCs to reproduce or distribute any material from this site, you must abide by the stipulations and terms of such a grant.
5. 5. The materials in this site are provided without any warranties of any kind. All visitors and users of this are entirely responsible for their own safety on this site. The CCLFMCs and or its partners are not liable for any damage to any user of this site or for any damage associated with the use of content obtained from this site.

1. 6. You are welcome to upload photographs, images and post comments.
2. 7. You agree not to transmit and or submit any information or material to this site that you consider to be confidential and or proprietary. Any information or material you transmit and or submit to this website shall be deemed non-confidential and non-proprietary information.

You further agree that for all content (including, without limitation, patent, copyright, and other intellectual property rights in such content, owned or licensable by you at any time without payment, ideas, concepts, know-how and techniques, uploaded, submitted or otherwise made available by you on the site and or to the users) you grant (or warrant that the owner of such rights has expressly granted) CCLFMCs and its partners a worldwide, unrestricted, royalty-free, fully paid up, irrevocable, perpetual, non-exclusive license to use, make, reproduce, import, compile, prepare derivative works of, publicly display, publicly perform, transmit, sell, distribute, sublicense, demonstrate, market, disclose, have made, offer for sale, lease, transfer or otherwise exploit such materials, and/or derivative works thereof, and authorize third parties to do any, some or all of the foregoing including, but not limited to, sublicensing others to do any, some or all of the foregoing indefinitely.  You represent that you are legally entitled to grant the rights and privileges conveyed by this section and warrant that such content, to the best of your knowledge, does not violate any other party’s patents, copyrights, trademarks or other intellectual property rights.
4. 9. You are entirely responsible for the content that you transmit and or submit to this site; including but not limited to its’ legality and liability. 10. All comments, images and photos are subject to review by the CCLFMCs before posting. CCLFMCs reserves the right to edit and or decline to post comments, images and photos that it determines are not suitable.

14. We may run advertisements and promotions from third parties on this site. Any action you may take based upon such advertisements or promotions of a third party, and any dealings you may have with such third party, are solely between you and that third party.

15. We are not responsible or liable for any loss or damage of any sort incurred as to result of any such actions or dealings or as a result of the presence of any advertisement or promotion on this site.

16. Interfering with, violating or attempting to interfere or violate the security of this site is strictly prohibited.

We reserve the right to investigate complaints or reported violations of this Terms of Use and Privacy Policy, and/or applicable licenses and copyright information on the site and to take any action we deem appropriate including, without limitation, reporting and providing information of any suspected unlawful activity to law enforcement officials, regulators, or other third parties, including disclosing any information necessary or appropriate to such persons or entities relating to user profiles, e-mail addresses, usage history, posted materials, IP addresses, and traffic information.

18. We reserve the right to seek all remedies available at law and in equity for violations of this Terms of Use and Privacy Policy, including, but not limited to, the right to block access from a particular Internet address to this site and to seek criminal/civil sanctions against you.

4. attempt  to access or access our server, data, information or services not intended for your access or usage
5. Interfere, corrupt or breach our security or authentication  measures, pretend to be the host or someone else, or spoof host’s or someone else’s identity

8. disrupt the normal flow of dialogue or otherwise act in a manner that negatively affects the normal function of or access to this site

Privacy and Storage of Information

20. You will be required to register on our website before being able to post a comment. By submitting your personal data to us, you consent its collection, processing and storage by CCLFMCs. We will collect your name and email address in order to authenticate posts and comments to our website. We will not use your personal information collected for distribution or sale. We will disclose your information if disclosure is legally required.

21. This website will use “cookies,” also known as browser cookies, only to allow users to remain logged into our website during the period of their choice. We will not store any information other than your name and email address.

22. If you choose to register on this site, you are responsible for providing accurate and complete information about yourself during registration and to updating such information to keep it current.  You accept all risks of unauthorized access to the information that you provide. CCLFMCs may, in its sole discretion, terminate the accounts or access rights of users who may have provided inaccurate or incomplete information during registration.

23. Notwithstanding anything to the contrary, if you choose to participate in an open source or community source process on this site, whether by contributing code, participating in mailing lists or sending e-mails, your participation is public and your privacy cannot be protected to the extent that you provide personal information such as your e-mail address. To the extent that you contribute code, information, articles or other material to this Website containing personal information, neither CCLFMCs nor its partners can protect the privacy of such personal information.

24. Your personal information will be maintained in a secure environment, accessible only to CCLFMCs. However, due to the nature of the electronic medium, we cannot guarantee or warrant the complete security of any or all of your personal information.

General Provisions

25. The materials in this site are provided “as is.” That is to say, without warranties of any kind, whether express or implied. To the fullest extent permissible pursuant to applicable law, CCLFMCs disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose.  You agree that CCLFMCs and or its partners do not warrant that the functions contained in the materials on this site will be uninterrupted, error-free, without defect, or will be corrected, or that this site or the server that makes it available is free of viruses or other harmful components. CCLFMCs does not make any representations or warranties regarding the use or the results of the use of the materials in this site in terms of their correctness, accuracy, reliability, or otherwise.

26. To the fullest extent permitted under applicable law, under no circumstances, including, but not limited to, negligence, shall CCLFMCs and or its partners be liable for any compensatory, punitive, special or consequential damages that result from the use of, or the inability to use, the materials in this site, even if CCLFMCs, its partners or an authorized representative has been advised of the possibility of such damages or losses. Applicable law may not allow the limitation or exclusion of liability or incidental or consequential damages, and so to that extent the above limitation or exclusion may not apply to you.

You agree to indemnify, defend and hold CCLFMCs, its affiliates and any of its and their directors, employees, agents and contractors harmless from and against any and all claims, damages, losses, costs (including without limitation reasonable attorneys’ fees) or other expenses that arise directly or indirectly out of or from (i) your breach of this agreement; and/or (ii) your activities in connection with this site.

28. The laws of Jamaica apply to this contractual agreement.

29. Any failure to exercise promptly any right under the Terms of Use and Privacy Policy will not create a waiver of any such right. Any express waiver of any right under the Terms of Use and Privacy will not create a continuing waiver or any expectation of non-enforcement.

30. If any provision of the Terms of Use and Privacy Policy is held invalid by any law or regulation of any government, or by any court or arbitrator, such provision will be replaced with a new provision that accomplishes the original business purpose, and the other provisions of the Terms of Use and Privacy Policy will remain in full force and effect.
